By using our website or services, you confirm that you have read and agreed to this Privacy Policy. Our services are intended for adults only. If you are under 18, please do not submit any personal data to us.

1. Who We Are

Ocelot TALENT is a nearshore staffing and talent placement company headquartered at 5900 Balcones Drive, Suite 100, Austin, TX 78731, USA. We connect US-based companies with professionals across Latin America, primarily in Mexico, Colombia, Brazil, and Argentina.

2. Who This Policy Covers

This policy applies to three groups of people:

  • Clients — companies that engage us to find or manage talent
  • Candidates — professionals we source, assess, and place into roles
  • Website visitors — anyone who browses ocelottalent.com or submits an inquiry

3. What Data We Collect and Why

Clients

We collect your name, company name, email address, phone number, job descriptions, and details about your hiring needs. We use this to provide our services, communicate with you, send invoices, and improve how we work together.

Candidates

We collect your name, contact details, CV and work history, education, skills, professional references, assessment results, and salary expectations. Reference and background check information may also be collected as part of our vetting process. These are sensitive categories of data and are handled with additional care — used only for placement purposes and not shared beyond what is necessary to evaluate your suitability for a role.

Once placed, we may collect ongoing performance data as part of our aftercare program (see Section 6: AI Tools).

Website Visitors

When you submit a contact form or book a discovery call, we collect your name and email address. We also automatically collect certain technical data when you visit our site, including your IP address, browser type, device type, pages visited, and time on site. This is standard practice for all websites and is used to maintain site security, analyze usage, and improve performance.

4. Legal Basis for Processing

We process personal data on the following grounds:

  • Contract — to deliver the services you have engaged us for
  • Legitimate interests — to operate our business, improve our service, and maintain client and candidate relationships
  • Legal obligation — to comply with employment, tax, and data protection laws in the countries we operate in
  • Consent — where we ask for it specifically, such as for marketing communications

Candidates and clients in Brazil, Mexico, Colombia, and Argentina have rights under their respective national data protection laws (LGPD, LFPDPPP, Law 1581, and Law 25.326). These rights are set out in Section 11 and apply equally regardless of location.

5. Who We Share Your Data With

We share data only where necessary:

  • Clients — candidate profiles and assessment results are shared with the client company during the placement process
  • Candidates — limited client information is shared with candidates so they can assess the opportunity
  • Scheduling tools — when you book a call via Calendly, your name and email are processed by Calendly under their own privacy policy (calendly.com/privacy)
  • Payroll and compliance partners — under our Nearshore Staffing model, we work with local partners in Mexico, Colombia, Brazil, and Argentina to manage payroll, benefits, and employment compliance. These partners receive only the data required to fulfil that function
  • Analytics — we use website analytics tools to understand how our site is used. These tools may collect IP addresses and usage data
  • Legal and regulatory authorities — where required by law

We do not sell personal data to third parties.

6. AI Tools and Automated Processing

As part of our aftercare program for placed talent, we use AI-powered tools to track performance indicators such as engagement, output quality, and responsiveness. This data is used to support coaching conversations and identify where additional training or support may help.

We do not use fully automated decision-making to determine employment outcomes. All significant decisions about a candidate's placement, continued engagement, or development are made by a human. Candidates are informed of this monitoring before it begins.

7. Marketing Communications

If you have engaged with us or submitted an inquiry, we may occasionally contact you with relevant updates or information about our services. You can opt out at any time by replying to any email with "unsubscribe" or emailing hirewithus@ocelot-talent.com. We will not send unsolicited marketing to candidates or clients who have asked us to stop.

8. Business Sale or Transfer

If Ocelot TALENT is sold, merged, or transfers its operations to another entity, your personal data may be transferred as part of that transaction. In such cases, we will take reasonable steps to ensure your data continues to be handled in accordance with this policy, and we will notify you if there is a material change to how it is used.

9. International Data Transfers

Because we operate across the US and Latin America, personal data may be transferred between these jurisdictions in the course of delivering our services. Where data is transferred across borders, we take steps to ensure it is protected to a standard consistent with applicable law, including through contractual agreements with our partners.

10. How We Keep Your Data Secure

We maintain appropriate technical and organizational measures to protect your data against unauthorized access, loss, or disclosure. These include access controls, encrypted communications, and restricted internal access based on role.

No internet transmission is completely secure, and we cannot guarantee absolute security. In the event of a data breach that is likely to affect your rights or interests, we will notify you and, where required by law, the relevant regulatory authority within the legally required timeframe (72 hours under GDPR and LGPD; as soon as reasonably practicable under US state laws).

12. Your Rights

Regardless of where you are located, you have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate or incomplete data
  • Request deletion of your data, subject to legal retention requirements
  • Object to or restrict how we process your data
  • Receive a copy of your data in a portable format
  • Withdraw consent at any time where consent is the basis for processing
  • Opt out of the sale of your data — we do not sell personal data, but California residents may formally assert this right under the CCPA by contacting us

If you are unsatisfied with our response, you have the right to lodge a complaint with a supervisory authority in your country. For US residents this may include your state Attorney General's office. For Brazilian residents, the relevant authority is the ANPD. For EU/UK residents, your local Data Protection Authority.

13. Cookies

Our website uses cookies to support site functionality and analytics. Cookies are small files placed on your device that help us understand how the site is used. You can control or disable cookies through your browser settings, though some features of the site may not function correctly without them. We do not use cookies for advertising or cross-site tracking.
